REVISED INTEGRATED
HOUSING SCHEME (RIHS) 2007 FOR BEEDI WORKERS ETC.
1.OBJECTIVE
OF THE SCHEME: -
The
scheme is intended to relieve, to some extent, the housing shortage mainly
among the BEEDI WORKERS. Welfare Commissioners
of respective Regions had earlier been supervising and monitoring erstwhile
Integrated Housing Schemes of this Ministry, which was modified, vide G.O. No.
M-11011/1/05-W. III dated 27th May, 2005 wherein; powers were
delegated to the State Governments for the purpose of implementation,
monitoring and supervision. On the advise of Honble Union Minister for Labour
& Employment, a Committee was constituted to review this arrangement. On
the basis of recommendation of the Committee, it was concluded that major
objectives have not been achieved. Consequently, with the concurrence of the
Union Finance Ministry (Department of Expenditure) it was been decided, that
for the purpose of execution, supervision and effective monitoring/control of
this Scheme also, the implementing agency will be the Director General Labour Welfare, Ministry of Labour
& Employment through the Welfare Commissioner of the region concerned. The
concerned Welfare Commissioner would identify the eligible Beedi
Workers, collect and scrutinize their applications, and send the proposal,
along with details of eligible workers in the prescribed Checklists, to the
Director General Labour Welfare, Ministry of Labour & Employment, Govt. of India, New Delhi for
grant of administrative approval for uniform central subsidy of Rs. 40,000/-
per tenement per worker for construction of a house by an Individual Beedi Worker and/or by the Co-operative Society for
construction of Group Housing Colony for workers and from the State Governments
concerned for proposal received under the Economically Weaker Section (EWS) for
construction of houses for Beedi Workers.The benefits of above Scheme would also be
available to the Non-coal Mine Workers engaged in the Iron Ore Mines, Manganese
Ore Mines & Chrome Ore Mines (IOMC) and Limestone Ore Mines, Dolomite Ore
Mines (LSDM) and Mica Ore Mines, under their respective Workers Welfare Funds.
2.The
details of the Revised Integrated Housing Scheme (RIHS) 2007 are as
under:
(a)LAND:
-
(i)The house may be constructed
on the land site possessed by the Beedi Worker
himself jointly/severally with other members of his family or on land given by
the State Government/Gram Sabha with a clear title in
the name of the worker. The land area should not be less than 60 Square
yards. However, housing subsidy may also be granted to the owner of the
plot of smaller area/size, provided the plinth area of the constructed house is
not less than 160 Square feet in case of Economically Weaker Sections (EWS),
Scheduled Castes and Scheduled Tribes, who are allotted land by the State
Government or local bodies. In such cases, the exclusive ownership of land
shall not be insisted upon and plot of small area/sizes can also be considered
for grant of subsidy; provided the plinth area of the houses constructed
is around 160 sq.feet and standards &
specifications laid down in Indira AwaasYojana are broadly followed.
(ii) The land allotted by the State Government and having leasehold
right for not less than 20 years, with further provision for extension of
lease, would also qualify for grant of subsidy.
(b) COST:
-
The minimum cost of the construction of a house would be Rs. 45,000/- per tenement If the cost of a house goes beyond Rs.
45,000/- (Rs.40, 000 Central subsidy + Rs. 5,000/- workers contribution), the
balance amount would be borne by the worker either through his own resources or
assistance in the form of loan from financial institutions like HUDCO etc, or
contribution from the State Governments in the form of subsidy/loan, if any. Adwelling unit costing up to Rs. 1.00 Lakh would be admissible for construction under
the Scheme.
(c) MODE OF APPLICATION: -
The applications in the prescribed form, complete in all respects, shall be
deposited by the Beedi Worker in case of individual
house and/or by the Co-operative Group Housing Society with the Welfare
Commissioner of the concerned region.
The Welfare Commissioner of the
concerned region will identify the eligible beedi
workers, collect and scrutinize
their applications and send the proposal, having details of eligible workers in
the prescribed Checklists, with his recommendations, to the Director General Labour Welfare (DGLW) forseeking administrative approval release of
subsidy.In case of construction of
houses for Beedi /Non-coal Mineworkers in
clusters/Groups by the State Government concerned through its nodal agency
under the EWS Component; the subsidy would be released to the State Govt., on
recommendation of Welfare Commissioner of the region concerned, by the DGLW in
the manner specified in sub-Para (d) of Para No. 2 as below.
(d) SUBSIDY: -
A
uniformCentralSubsidy of Rs. 40,000/- per worker per
house would be granted. The Director General Labour
Welfare would release first installment of the subsidy i.e. Rs. 20,000/- per
tenement, after confirmation of receipt of workers contribution @ Rs.
5,000/- per beneficiary after grant of administrative approvalfrom
the Welfare Commissioner of the region concerned, and for the purpose
of construction of the house till the roof level. The Second Installment of Rs.
20,000/- per tenement would be released by the Director General Labour Welfare on receipt of report of 100% inspection
conducted by the Engineers of Labour Welfare
Organization of construction reaching roof level(before roof is laid) and after
ascertaining the progress for the purpose of completing the construction in all
respects, together with workers contribution of Rs. 5,000/- received after
grant of administrative approval.
(e) RELEASE OF SUBSIDY:-
A uniform subsidy @ Rs.
40,000/- per tenement would be released to the respective State Governments
during the beginning of each financial year. The State Government would release
the subsidy tot the respective District Collector/Deputy Commissioner of the
concerned district in two equal installments. The first installment of the
subsidy i.e. Rs. 20,000/- would be released by the respective State Government
on the basis of administrative approval granted by the DG(LW).
The Second Installment of the subsidy would
be
released by the State Government of reaching the construction at roof level,
after satisfying about the utility of the 1st installment.The District Collector/ the Deputy Commissioner will designate an
inspecting authority to inspect each tenement during the construction phase and
after its completion.
(f) UTILISATION
CERTIFICATE: -
A Combined Utilization/Completion
Certificate would be sent by the Welfare Commissioner to the Director General Labour Welfare, Ministry of Labour
& Employment, Govt. of India, New Delhi, in respect of construction of
houses by the Beedi workers individually or by the
Co-operative Group Housing Societies. In case of construction under the EWS
component, the State Government would send information periodically in the prescribed
Combined Utilization/Completion Certificate.The procedure and proforma for the Checklists
and Utilization Certificates, for the release of first installment as well as
release of the subsequent installments, and completion certificate etc.Would
continue to be on the basis of prescribed forms, checklists, etc. circulated with the
erstwhile RIHS, 2005.
(g) OWNERSHIP OF TENEMENTS:
(i)
In case of construction work undertaken by the State Government under EWS
Component of the Scheme, the State Government concerned, through its Labour Secretary, would enter into an agreement, as prescribed, with the Union Labour
& Employment Ministry, Govt. of India. It would also furnish, within one month of the close of the financial year in
which subsidy is released, the utilization
certificate as prescribed.
(ii)Where the houses are
constructed by the workers themselves or by the Co-operative Society of Workers
on the land owned by the workers/Society, the ownership of the house shall vest
with the worker or the Society, as the case may be. He and/or the Society, shall execute an
agreement in favour of the President of India for the
sum subsidy so received. He and/or the
Society shall also execute any other agreement as prescribed, wherever
applicable. Further, the Society or
beneficiary shall provide surety for the amount of subsidy, which shall be
signed in favour of the Government. Where it is not possible to arrange a surety,
the applicant shall mortgage the land on which he proposes to construct a house
in the prescribed form for the purpose.
(iii)The house, so
constructed, would not be sold or transferred by the beneficiary before
15 (fifteen) years, except in the case of legal heirs.
(h)
CONDITIONS FOR ELIGIBILITY: -
(i)Any Beedi worker
whether an employee of an establishment or a GharKhatta
worker who has been engaged in the Beedi industry for not less than one year A worker shall be
allowed to construct only one house. The monthly
income of the family should not exceed Rs.
6,500/- per month.
(ii)The worker should have a land in his/her
name or on land allotted by the State Government/Gram Sabha;
and would also contribute in the form of personal/family Manual Labour for construction of the tenement.(iii)The applicant Beedi
Worker would deposit an amount of Rs. 5,000/- as worker’s contribution with the
Welfare Commissioner of the concerned region after grant of
administrative approval by the DGLW and before the release of 1st instalment of subsidy by the DGLW. Worker’s contribution
would be deposited with the State Govt. in case of construction of EWS houses
by the State Govt.
(iv)The applicant Beedi Worker should not have a House in his/her own name or
in the name his/her spouse or any of the dependents.
(v)T
he applicant Beedi
Worker or his/her spouse or any of the dependents should not have earlier
availed the facility of financial assistance under any housing scheme of the
Central and/or the State Government.
(vi)The house/flat
would be completed within a period of 18
months.(vii)All
the above conditions of eligibility would be applicable to Iron Ore/Lime Stone
Ore, Dolomite Ore, Chrome/Mica Ore & Manganese Ore Mine workers except in
their cases; the family monthly income should not exceed Rs. 10,000/-.
(i) PLAN, STANDARD, SPECIFICATION AND
CONSTRUCTION: -
Each dwelling unit should, at least,
have a living room with a closet area for the cooking; a bathroom and a toilet
within a plinth area of not less
than 160 square feet. The State
Government or its agencies should approve the plan, but the specifications
chosen would be such as to make the house durable. The tenements shall be constructed in a good,
substantial and habitable manner and their estimated
life should not be less than 20
years. The standard type design
would, however, depend on local climatic conditions and beneficiary’s specific
requirements. Each dwelling unit should have facilities like electricity,
drinking water and water for conservancy and sanitation.
The
above standards are in the nature of minimum and there would be no objection to
adoption of better specifications and higher standards by individual workers
while constructing their own houses under the scheme. The worker or Workers’
Co-operative Society, in that case, could raise the remaining finances, either
by loan/contribution from the State Governments or any other agencies like
HUDCO or financial institutions/Banks etc. The State Governments may also
provide financial assistance in the form of State subsidy to enable the workers
to construct house of better specification and higher standards.
(j)PENALTIES & INTEREST: -
If the tenements are
not constructed and completed in all respects within the stipulated
period/extended period, the amount of subsidy shall be forfeited and recovered along
with penal interest to be determined by Govt. of India from time to time. The
subsidy and such penal interest shall be recovered as arrears of land revenue.
(k)In case of construction of houses for the Beedi workers under the EWS component, no
additional staff or creation of new staff by the State Government would be
allowed and no additional expenditure would be allowed to the State
Government. The State Government would
provide infrastructure facilities. No
other fund for any other purpose, other than specified in the Scheme, would be
granted to the Co-operative Society or to the State Government.
3.APPROVAL
& RELEASE OF SUBSIDY: -
(i)The Revised Integrated Housing Scheme
(RIHS), 2007 for Beedi Workers etc. would be
applicable on or after 1st
April, 2007 i.e. from the next financial year. Past cases, where sanction
has already been granted, would be considered under the erstwhile schemes like
Integrated Housing Scheme 1999, 2001 & 2004 and RIHS-2005.
(ii)The Director General Labour
Welfare, Ministry of Labour & Employment, Govt.
of India, would grant administrative approval and sanction release of the
subsidy on 50:50 basis for the construction of
houses.
(iii)The Central Subsidy of
Rs. 40,000/- per tenement would be released on 50:50basis. The first
installment of the subsidy i.e. Rs. 20,000/- per tenement, as advance subsidy,
would be released by the Director General Labour
Welfare at the time of grant of administrative approval for the purpose of
construction of the house till the roof level. The balance of 50%, i.e. 2ndInstallment
of Rs. 20,000/- of the total subsidy would be disbursed when 50% progress, i.e.
construction reaching on roof level is reported to the DGLW.
(iv)The release of
subsidy would be subject to availability of funds for the purpose during the
financial year.
4.MECHANISM
FOR INSPECTION/REVIEW: -
(i)In
case of construction by the worker himself/herself and/or by the Co. operative
Group Housing Society, theWelfare Commissioner,
through the Engineers and other field officers of Labour
Welfare Organization, would conduct 100% inspection/verification of progress of
work, on reaching the construction at roof-level and finally after completion
of construction in all respects and send such report(s) to the Director General
Labour Welfare.
(ii)In case of construction under the EWS,
the State Government would conduct a 100% inspection of houses, through its
inspecting agency, reached at roof level (before roof is laid), and send a
report, through the Welfare Commissioner of the region concerned, for the
release of 2ndInstallments of the subsidy by the DGLW. The State
Govt. would also send an inspection report, after 100% inspection of houses,
completed in all respects, in the same manner as above. Director General (Labour
Welfare) or officers from the Ministry and/or Labour
Welfare Organization (field Officers) would conduct random checks of
houses constructed by the State Govt., from time to time, to ensure
proper utilization of housing subsidy.
(iii)Director General Labour Welfare and/or officers from the Ministry, Labour Welfare Organization (field Officers) and Labour Department of the State Government would make a
periodic review (every six months) of the Scheme in case of houses
constructed under the Economically Weaker Section (EWS) component. However,
Welfare Commissioner of concerned region would be mandated to inspect the
progress as part of their duties.
5.RELAXATATION:
-
Ministry
of Labour may relax any or more conditions of the scheme
or related-matter pertaining to the Scheme, in exceptional circumstances, or
where it is satisfied that such condition/conditions are likely to cause
hardship to the worker/workers.
